Terms and Conditions

1. PRICES OF THE PROPOSED STAYS

All prices are given in Euros or US Dollars.
Payments can be made by the following means of payment: In cash directly to our sales staff on delivery of a receipt, by credit card via the secure online Paypal platform (Visa, Diner's, Master Card, American Express), check & bank transfer. For each of the proposed journeys or trips, an indication is given of what the prices include and do not include. Unless stated otherwise in the offer description, prices do not include: extra luggage, any service before checking in at departure or after returning to the airport, national and international airport taxes, eco-taxes, electricity taxes, exit taxes charged in certain countries and that have to paid on the spot in local currency or US Dollars, tourist taxes for Algeria, single room supplement, drinks, telephone calls, optional excursions, sports activities, personal expenses and tips. 
Our prices are likely to be modified (increased or decreased), up to thirty days before departure, to take into account any major variations of: The cost of transport, particularly related to the cost of fuel.
Fees and taxes related to the services offered, such as landing, embarkation and disembarkation taxes in ports and airports.
Exchange rates applied to the considered trip or stay. If the amount of the increase exceeds the indicated prices by more than 10 %, the client will have the possibility to cancel his or her trip without any costs, by sending a registered letter with acknowledgement of receipt no later than eight days after having had knowledge

2. FORMALITIES TO BE COMPLETED BEFORE TRAVELLING

 

Foreign nationals should check with the consular authorities of the country or countries of destination for health information. It is the responsibility of each participant (adult and child) to check that they are in compliance with the legislation of each country, both on departure and on arrival. The costs of issuing passports, visas and other customs documents are in all cases to be paid by the client and remain so. Riwaya Travel, through its partner agency, can in no case be held responsible for sanctions and/or fines possibly imposed on participants, as a result of the non-compliance with health and/or customs regulations in Algeria or in the country of destination as well as the consequences that may result, nor be held liable, nor reimburse the price of the trip or stay when the client cannot embark or be admitted to the territory of destination, due to the failure to present identification and/or health documents necessary for the completion of his or her trip or if the client presents outdated documents.

3. SUBSCRIPTION CONDITIONS

 

The client receives an e-mail message allowing him or her to access the online quote. The information published on the website, the online estimate as well as the booking form including: the terms and conditions, the conditions for crossing borders, the weather information, the optional subscription of a travel insurance offer, constitute the preliminary information. The registration to one of the trips or stays proposed implies the acceptance of the present terms and conditions and the particular conditions included, as the case may be, in the booking form of the selected trip. Any reservation is only taken into account upon receipt of the reservation form accompanied by a deposit representing 30% of the total price, subject to availability. The reservation is confirmed to the client within 48 hours following the reception of the form and the deposit. The client must pay the outstanding balance no later than 30 days before departure. When the registration is made less than 30 days before departure, full payment is due upon confirmation of the registration. Delivery of notebooks or travel documents: The delivery of the travel documents at home or to the e-mail or postal address indicated by the client will generally take place at least 08 days before the date of departure of the client; except in exceptional cases when documents are handed over at the airport.

 

 

4. CANCELLATION POLICY

 

4.1. Cancellation by the client on an individual trip

For any cancellation occurring in the periods defined below, the following percentage will be deducted from the total amount of the price of the trip depending on the number of days preceding the date of departure:
between the 45th and 31st day: 25%
between the 30th and the 21st day: 50%
between the 20th and 15th day: 75%
between the 14th day and the day of departure: 100%.
For any cancellation occurring more than 45 days (the date considered being the date of receipt of the cancellation letter) before the scheduled departure, an amount of 100 € per person will be retained as cancellation fees. These lump sums may be increased in the following cases: The minimum lump sum being 150 € per person. When the payment has been made by credit card, bank commission charges are added: 5% for all cards.
*Special Cases: Christmas and New Year's period. During the Christmas / New Year holiday periods (17 Dec / 09 Jan) special booking and cancellation conditions apply: Minimum duration on site requested by the establishments. Cancellation policy before departure modified as follows: from the date of booking confirmation until the day of departure: 100% cancellation fee. Due to the special conditions applied by hoteliers during the Christmas and New Year's period (17 Dec/ 09 Jan), cancellations due to unforeseeable events such as strikes or weather disasters will not give rise to any refund or postponement of unused hotel services. (Our clients are advised to take out cancellation insurance for this period.) Any cancellation must be confirmed in writing (registered 
letter with acknowledgement of receipt, telegram, fax, etc.), the date of receipt determining the date of cancellation.
The sums withheld for cancellation or modification may be reimbursed in full (less the cost of the insurance contract and any deductible) by taking out "cancellation insurance" under the conditions of the cover provided by the latter (such as illness, accident, death, etc. clearly justified). This insurance may be taken out with the Riwaya Travel tour operator and its partner agency when booking the trip. In this case, the insurance claim must be sent by the client to the insurance company which will proceed, where applicable, directly to the reimbursement. Riwaya travel and its partner agency do not intervene at any time in this operation.

 

 

4.2 Cancellation by the client on group trips or grouping together of individual travelers trips (G.I.R)

For any cancellation occurring in the periods defined below, the following percentage will be deducted from the total amount of the price of the trip depending on the number of days preceding the date of departure:
between the 60th and 31st day: 25%
between the 30th and the 11th day: 75%
between the 10th day and the day of departure: 100%.

 

For any cancellation occurring more than 61 days (the date considered being the date of receipt of the cancellation letter) before the scheduled departure, an amount of 100 € per person will be retained as cancellation fees. These lump sums may be increased in the following cases: When the payment has been made by credit card, bank commission charges are added: 5% for all cards. Any cancellation of more than 50% of the reserved rooms, occurring after the confirmation of the option, up to 60 days of the arrival, is subject to 30% of the fees. Any room cancellation, occurring less than 60 days before the date of arrival is subject to 75% of retained fees. Any no-show is subject to 100% of the fees. Any cancellation must be confirmed in writing (registered letter with acknowledgement of receipt, telegram, fax, etc.), the date of receipt determining the date of cancellation. 5. MODIFICATIONS

Any modification of the file made by the client before departure, such as the increase in the number of passengers, additional land services, will entail at his or her expense variable costs depending on the nature of the number of modifications and the date on which the modifications are requested. These costs will be added to any costs requested by the service provider and of which the client will be informed before the modification is carried out.  Any other modification not mentioned above (modification of the dates of the trips, departure dates, change of destination, modification of an itinerary) are considered as a cancellation as provided for in article 4.1. The client may assign his or her contract (excluding the insurance contracts) to a third party, provided that he or she informs us in writing at least 15 days before the start of the trip, indicating precisely the name and address of the assignee(s) and the participant(s) in the trip and justifying that they meet the same conditions as him or her to make the trip or journey (in particular for children who must be in the same age groups). The assignor and the assignee are jointly and severally liable for the payment of any outstanding balance and for any additional costs arising from such assignment. The assignment does not concern airline tickets issued before notification of the change; the change of name is not accepted by airlines on tickets already issued in accordance with civil aviation security rules.  Due to the always possible hazards in travel and stays, especially abroad, participants are warned that what is described to them is the rule but that they may note and experience exceptions.  If essential elements are to be modified before departure, the client will be informed by any means (telephone, fax, e-mail) and by registered letter with acknowledgement of receipt. This will offer the client either the possibility to cancel his or her trip free of charge, or the possibility to subscribe to a new offer. If, during the trip, we are unable to provide a significant proportion of the services provided for in the contract, we will offer you replacement services at no extra charge. If these services are impossible to provide or refused by the client for a valid reason, we will offer tickets to transport the client to the place of departure or another place agreed on by both parties. 

 

6. CONDITIONS OF PERFORMANCE OF SERVICES 

6.1  Accommodation

 

The number of stars awarded to the hotel listed in the description corresponds to a classification established with reference to local standards in the host country and which may therefore differ from French and European standards. However, we do our best to inform you as precisely as possible about the conditions of your accommodation. Hotel entrance and exit: Unless otherwise provided, hotel rooms are available from 15:00 (Check-In) and are to be vacated at 11:00 am on the day of departure (Check-Out). If the client wishes, it is possible in certain establishments to reserve the Early-Check-In or Late-Check-Out option at an extra charge, subject to availability. The cost of such an option varies between 50 and 100% of the price per night on the given date. The number of meals depends on the number of nights spent in the hotel. Full board begins with dinner on the first night and ends with breakfast after the last night. Half board starts with dinner on the first night and ends with breakfast after the last night: it includes one breakfast and one meal per day. If certain meals are not served due to flight schedules or delays, we cannot proceed to any refund. Whether full or half board, drinks are not included, unless duly mentioned in the description. It may happen that one of our suppliers has to change the hotels or boats mentioned without this measure constituting a modification of an essential element of the trip. Whenever possible, the client will be notified in advance and will receive a service of the same category as initially proposed. No compensation can be claimed by the client. Similarly, in some countries, the circuits and self-tours may be modified but all the visits and stops planned will be respected. Due to the always possible hazards in travel, especially abroad, participants are warned that what is described to them is the rule but that they may notice and experience exceptions for which we apologize in advance. Civil and religious holidays, strikes and demonstrations in the countries visited are likely to lead to changes in the visits or excursions, for which we cannot be held responsible. It can happen that certain activities indicated in the description are removed by our local provider in particular for climatic reasons, in case of force majeure, stay out of tourist season, or when the minimum number of participants required for the realization of the activity is not reached (examples: collective sport, children's club). Some proposed activities may present risks, especially for young children. We cannot be held liable in the event of an incident or accident attributable to a lack of vigilance on your part.

 

6.2  Air Transportation

 

Flight schedules, aircraft types, itinerary, the identity of the contracting carrier (list of up to five) and possibly that of the actual carrier are given for information both on departure and return. They may be subject to modifications, be delayed up to 48 hours (even after confirmation), on the initiative of the carrier or civil aviation services, without our liability being engaged. The conditions of charter aircraft make it necessary to remind that any charter seat abandoned on the outward or return is not refunded, even in the case of a date postponement. Abandoning a seat on a special flight to take a scheduled flight entails full payment by the client of the fare at the official rate. Due to the volume of air traffic and events beyond our control (strikes, technical incidents or other), delays may occur. In accordance with international conventions, correspondence is not guaranteed. No compensation shall be granted. It is therefore advisable not to make any commitments the day or the day after the outward or return journey. Flights may be direct (with or without stopovers), or include a stopover with a change of aircraft. Furthermore, the carriers reserve the right, in the event of circumstances beyond their control or technical constraints, to transport clients by any mode of transport of their choice, with due diligence and without any compensation being claimed by passengers. The name of the airport, when there are several airports in the city, may be subject to change without compensation. 

 

 

6.3 Illustrations

 

The photos, plans and illustrations of the descriptions presented on the website are provided by hotel establishments and service providers to give an overview of the services they offer and are published and distributed under their full and entire responsibility. They shall in no case engage the responsibility of the tour operator Riwaya Travel and its partner agency. 

7. CLAIMS

 

After having contacted the agency's client service department and in the absence of a satisfactory answer within 60 days, the client may contact the Algerian Tourism and Travel mediator at the Algerian Tourism Department. This contract is subject to French law and any dispute, if not settled amicably, may be brought before the competent court in the jurisdiction of the client's domicile.

8. OPTIONAL TRAVEL INSURANCE

 

The agency strongly recommends that its clients take out comprehensive travel insurance. Insurance guarantees will be provided to clients prior to registration. Each traveler is responsible for reporting claims to the insurer within the time limits specified in the summary of the insurance text provided to him or her.
